1. About these terms

These terms apply to the use of this website and to the sourcing, quality-inspection, freight, customs-clearance and delivery services provided by Balar Overseas, 146, Royal Square, Opp. Silver Business Point, Utran, Surat, Gujarat 394105, India. By placing an order or asking us to act for you, you accept them. Anything agreed in writing in your quotation or order confirmation takes priority over these general terms.

2. Our role

We act as your sourcing and logistics partner. We find and verify suppliers, negotiate, inspect, consolidate, ship, clear customs and deliver. The goods themselves are manufactured and sold by the supplier; we are not the manufacturer.

3. Quotations and orders

• Quotations are based on the product, quantity, packing, shipping method and delivery city you give us, and are valid for the period stated on them (7 days if nothing is stated)
• Prices can change with factory prices, exchange rates, freight rates, duty rates or a change in your requirements; we tell you before going ahead
• An order is confirmed once you approve the quotation in writing (WhatsApp or email is fine) and the agreed advance is received
• Minimum order quantities are set by the factory and differ by product

4. Payment

Payment terms are stated in your quotation. Normally an advance is paid to start production and the balance before the goods are shipped or delivered. Duties, taxes and government charges are payable as assessed at the time of clearance. Goods may be held until outstanding amounts are paid.

5. Your responsibilities

• Give accurate product specifications, quantities and delivery details, and approve samples or photos when asked
• Hold the registrations needed to import, such as IEC and GST, and provide KYC and other documents on time
• Make sure the goods are legal to import into India and tell us about any licence, certification or labelling rule that applies to them
• Be available to receive the delivery and check the cartons on arrival

We do not handle prohibited, counterfeit or undeclared goods.

6. Quality inspection

Pre-shipment inspection is carried out against the specification and sample you approved, on a sampling basis, and reported to you with photos. It greatly reduces the risk of defects but is not a manufacturer’s warranty and cannot guarantee that every single unit is free of faults. If a problem is found before shipment we work with the factory to have it corrected.

7. Shipping, customs and delivery

Transit times are estimates. Delays caused by shipping lines, airlines, ports, customs examination, weather, holidays or government action are outside our control. Duties and taxes are decided by the customs authorities. See our shipping policy for details.

8. Cancellations and claims

• An order can be cancelled without charge before the supplier has been paid or production has started; after that, the supplier’s charges and costs already incurred are deducted
• Shortage or visible damage must be noted on the delivery receipt and reported to us with photos within 48 hours of delivery
• Quality claims must be reported within 7 days of delivery with photos or video; we take them up with the supplier on your behalf
• Goods cannot be returned to the supplier without prior agreement

9. Liability

We take proper care of your order at every stage. Our liability for any loss arising from our services is limited to the service fee charged for the shipment concerned, and we are not liable for indirect losses such as lost sales or profit. Cargo insurance is recommended and can be arranged on request. Claims for loss or damage in transit are subject to the terms of the carrier and the insurer.

10. Website content

The text, images, 3D scenes and design of this website belong to Balar Overseas or are used under licence (see credits) and may not be copied for commercial use without permission. Information on the site is general and is not a quotation.

11. Governing law and contact

These terms are governed by the laws of India, and the courts at Surat, Gujarat have jurisdiction over any dispute.
